3) Right to Opt-Out

  • Sale of Personal Information: Consumers have the right to direct a business that sells personal information to stop selling their information.

4) Right to Correct

  • Correction of Inaccurate Information: Consumers can request that a business correct inaccurate personal information maintained about them.

5) Right to Limit Use of Sensitive Personal Information

  • Definition: Sensitive personal information includes data such as Social Security numbers, financial account information, precise geolocation, racial or ethnic origin, and biometric information.

  • Limitation Request: Consumers can direct businesses to limit the use and disclosure of their sensitive personal information to that which is necessary to perform the services or provide the goods reasonably expected by an average consumer.

6) Right to Non-Discrimination

  • Prohibited Practices: This includes denying goods or services, charging different prices or rates, or providing a different level or quality of goods or services.

Data Breaches and Your Right to Take Legal Action

A significant provision of the CCPA allows consumers to sue businesses in the event of certain data breaches. If your personal information—such as Social Security numbers, financial data, or biometric information—is exposed due to inadequate security measures, you may be entitled to damages.
